When a replacement builder finally completes a stalled project, the relief is understandable. The site is active again, the house looks finished, and the owner can move in, rent it out or refinance.

However, a finished house does not necessarily mean that every part of the first builder’s work has been inspected and verified.

Some of the most expensive defects are hidden below the slab, behind skirtings and wall linings, inside floor cavities, within the roof space or below the ground beside the footings. A replacement builder may complete all outstanding work correctly while pre-existing defects remain concealed.

A completion scope and a hidden-defect investigation are two different things. Unless the replacement builder’s contract includes targeted investigation, testing and opening-up, no one can confirm the condition of work that cannot be seen.

This is not a theoretical risk. Across the takeover project records reviewed for this article, subsequent investigations produced additional defect rectification scopes ranging from $172,649 to $217,913.60, expressly separate from the cost of completing unfinished work. Another project recorded $177,647.81 in defect rectification costs, also separate from incomplete work. These figures represent costed rectification scopes rather than automatic insurance payments, but they demonstrate how quickly concealed defects can become a six-figure problem.

Why finding defects now can change who pays

Where the first builder has become insolvent and the HBCF policy responds, accepted rectification costs may be covered under the Home Building Compensation scheme instead of being paid entirely by the homeowner.

Current SIRA guidance states that a homeowner may be insured for up to $340,000 per dwelling, subject to the policy limits and conditions. Current icare guidance describes $340,000 as the maximum amount that can be claimed on each policy issued on or after 1 February 2012. It is therefore not $340,000 for every individual defect. The current combined-cover product covers both non-completion and defects within the relevant periods, so the remaining amount available will depend on the particular certificate, policy and claim history.

The Home Building Regulation currently permits an insurance excess of no more than $250. However, the much more important limitation is the overall policy cap. If extensive incomplete work and substantial hidden defects exist on the same project, the total reasonable cost can approach or exceed the available cover.

HBCF is not an automatic payment simply because a defect is expensive. The insurer will still consider:

  • whether the property and work were insured
  • whether a valid claim trigger exists
  • whether the defect is attributable to the insured first builder
  • whether the loss was notified and claimed within the applicable period
  • whether the proposed rectification method and cost are reasonable
  • how much cover remains available under the policy

This is why the inspection must distinguish clearly between incomplete work, defective work performed by the first builder, work performed by the replacement builder and any owner-requested changes.

The two-year and six-year limits

For completed residential building work in NSW, the current general periods are:

  • six years from completion for major defects
  • two years from completion for all other defects or losses

If the breach or loss first becomes apparent during the final six months of the applicable period, an additional six months may be available.

The date of completion should not be assumed. Under NSW legislation, completion generally occurs when the work is complete within the meaning of the relevant building contract. On a takeover project involving two builders and more than one contract, the applicable date should be confirmed from the contracts, certificates, project records and policy position.

A major defect is a legal classification, not simply another name for an expensive defect. Major elements can include foundations, footings, floors, walls, roofs, columns and beams, as well as fire-safety systems and waterproofing. Whether a particular problem qualifies depends on its cause, seriousness and likely consequences. Calling an item “structural” does not by itself guarantee that the six-year period will apply.

Do not interpret six years as permission to wait

The two-year and six-year periods are outer limits, not recommended inspection dates.

SIRA says that icare should be notified in writing as soon as defective work is suspected, even if the full investigation and final quotation have not yet been completed. Notification must be made within the warranty period if the homeowner wants to preserve the ability to make a claim after that period.

The current Home Building Regulation also uses a six-month notification benchmark. Where the insurer is notified no later than six months after the homeowner first became aware, or reasonably ought to have become aware, of the relevant fact or circumstance, the insurer may not reduce its liability merely because notification was delayed. A policy may allow an extension or waiver, but homeowners should not rely on receiving one.

SIRA also describes a limited delayed-claim pathway of up to 10 years after completion where the homeowner has been actively pursuing the builder through Building Commission NSW, NCAT or a court. This is not a general extension for defects first investigated after the ordinary period has expired.

In practical terms, a serious defect discovered too late may fall outside HBCF cover and become an owner-funded repair.

Why structural defects can remain hidden for years

Structural components are generally installed early in the build. They are then covered by plasterboard, skirtings, flooring, cabinetry, insulation, roofing and external finishes.

A missing anchor may not be visible after the skirting is installed. Inadequately fixed floor joists may be hidden below flooring. Missing roof bracing may remain unnoticed above the ceiling. Defective footing support may sit below compacted soil and concrete.

The house may initially appear normal. Symptoms can emerge later as:

  • recurring cracks in walls or ceilings
  • doors and windows beginning to bind
  • movement or creaking under foot traffic
  • uneven floors
  • separation at wall or ceiling junctions
  • roof movement during strong winds
  • water penetration
  • progressive damage to finishes

By that stage, gaining access may require opening completed walls, lifting flooring, removing cabinetry or excavating around a finished and occupied home.

Hidden structural defects we have encountered

1. Wall frames not properly anchored to the concrete slab

The wall frame must be securely connected to the slab through anchors, brackets and hold-down points. These connections form part of the structural load path that resists wind uplift and sideways movement.

We have encountered missing anchors, excessive spacing, inadequate embedment, poor edge distances, loose fixings and broken hold-down paths. The wall can look perfectly normal after plasterboard and skirting are installed, even though the required connection is absent behind them.

We investigate these locations by making small, controlled openings at selected wall bases, using a borescope or small inspection camera, checking the anchor locations and measuring spacing, embedment and edge distance. Doubtful fixings can then be torque-tested to check whether they are securely engaged with the slab. On one documented project, this process identified 11 missing torque-testable hold-down locations.

2. Missing roof-truss bracing and restraints

A roof can be fully sheeted and appear complete while important bracing components are missing inside the roof space.

The defects encountered in the project records included missing speed bracing, discontinuous restraints, defective straps, missing web stiffeners, inadequate gable restraint and non-compliant fixings. These components prevent the trusses from moving sideways and help transfer loads through the roof structure.

We inspect accessible roof spaces and compare the installed arrangement with the truss layout and manufacturer’s bracing details. Each strap, restraint, stiffener and connection is checked, and missing or defective locations are marked before rectification.

3. Inadequately fixed upper-floor joists

Upper-floor joists may have been installed but not properly fastened, blocked or braced. Common warning signs include creaking, vertical or sideways movement under foot traffic and small gaps opening where joists meet supporting members.

In one documented takeover project, approximately 17 joists required rectification. The problem was confirmed through movement observations under load, inspection of accessible framing and local opening-up of the floor structure. The joists then required re-fixing and supplementary blocking, straps or restraint.

4. Concealed footing and bearing-support defects

Footings can be in the wrong profile or founded on inadequately prepared support even though the slab and house above them have already been constructed.

The defects recorded in the supplied documents included uneven bearing preparation, variable founding levels, over-excavation, incorrectly formed support levels and local areas without the required bearing relationship to the footing.

These conditions cannot be assessed reliably from inside the finished house. We identify suspicious areas through level surveys and a review of the engineering information, followed by targeted excavation and local exposure. A Dynamic Cone Penetrometer, which is a ground-testing probe, may be used to check the underlying material, with the exposed conditions then reviewed by an engineer.

5. Bowed, twisted or out-of-plumb wall framing

Plasterboard can disguise steel framing that is bowed, twisted or outside the required alignment. Over time, the resulting stress can contribute to cracking, uneven finishes, poorly aligned doors and windows, and problems with cabinetry or wet-area set-out.

Before close-up, we check wall lines with plumb readings, straightedges and opening measurements. In a completed home, selected locations can still be checked against adjoining surfaces and openings, with targeted access used where the measurements indicate a concealed problem.

6. Missing headers, noggings and fixing support inside walls

A wall may be standing but still lack the internal members needed to support openings, linings, wardrobes, kitchen joinery, fixtures and local loads.

The supplied project records document missing or inadequately fixed headers, noggings, backing plates, restraint members and other fixing supports. These were identified by inspecting exposed frame cavities before close-up and comparing the installed framing with the intended locations of robes, services, wet areas and fixtures.

Other concealed defects can be just as serious

Not every hidden defect is purely structural. Takeover projects can also contain concealed fire-safety, termite, drainage and waterproofing failures.

Below-slab sewer and stormwater defects have been located using pipe tracing and CCTV cameras inserted into the drains. Dye or pressure testing can confirm leakage or poor performance, after which only the marked locations need to be excavated and exposed. The recorded problems included incorrect falls, backfalls, poor bedding, defective junctions, leaks and non-compliant concealed connections.

Defective inter-tenancy fire separation has been investigated using small borescope access holes, smoke-pencil checks and targeted opening-up. This has revealed gaps, unsealed service penetrations and discontinuities at wall, ceiling and roof-space junctions that would otherwise have been concealed by finished linings.

Water penetration through garage slabs and thresholds has been confirmed with moisture readings, crack and joint mapping and controlled hose testing. These tests reproduce the leak and identify the actual water-entry route rather than relying only on the visible damp patch.

Termite-management continuity can also be compromised at slab edges, set-downs and service penetrations. The barrier must be inspected and mapped at vulnerable interfaces, because a missing collar, untreated gap or disturbed perimeter transition can create a concealed termite-entry route.

What a proper hidden-defect inspection should involve

A standard handover checklist is not enough for a project taken over from an insolvent or non-performing builder. A hidden-defect investigation should be risk-based and targeted.

It normally involves:

  • Reviewing the approved architectural drawings, engineering, truss layouts, drainage plans, certificates, photographs and first-builder records
  • Identifying which structural and concealed elements were installed by the first builder and which of them have never been independently verified
  • Beginning with non-destructive methods such as laser levels, straightedges, plumb measurements, moisture readings, thermal checks, borescopes and drain cameras
  • Making controlled local openings only where measurements, symptoms or project records indicate a genuine risk
  • Engaging the appropriate engineer, plumber, roofer, waterproofing contractor, fire specialist or termite contractor where specialist verification is required
  • Recording the location, test result, photographs, marked-up plan, cause, consequence, proposed rectification and reasonable cost of every confirmed defect

The final documentation should keep first-builder defects separate from unfinished work and from anything installed by the replacement builder. The attached deeds consistently treated defect rectification as a distinct scope rather than simply adding it to the cost of completing the house.

The best time to investigate

Ideally, the investigation begins as soon as a replacement builder takes control of the project and continues before each concealed area is closed. This provides the best access and the strongest evidence.

However, a targeted inspection remains valuable after practical completion. Roof spaces can still be accessed, wall bases can be examined through small local openings, drains can be inspected by CCTV, and waterproofing can be tested without demolishing the entire house.

Some problems also become easier to confirm after the house has been subjected to rain, normal foot traffic and operational use. Water-entry paths may appear only after sustained rainfall, while inadequately restrained floors may reveal movement only when loaded.

The critical point is not to wait until extensive cracking, structural movement, termite damage or long-term water penetration makes the defect impossible to ignore.

Finding the problem now is usually better than finding it later

Early discovery has several advantages:

  • the HBCF notification and claim periods may still be open
  • evidence of the first builder’s work is easier to preserve
  • the defect can be separated from the replacement builder’s work
  • access may require only small, controlled openings
  • secondary damage can be prevented
  • rectification can be coordinated before occupants, furniture or tenants complicate access
  • an accepted insurance claim may fund reasonable rectification within the policy limit

The same defect discovered years later may require substantially more demolition and reinstatement. It may also sit outside the applicable insurance or statutory warranty period, leaving the homeowner to fund the investigation, engineering, opening-up, repair and restoration.
