Stoppage does not always end the contract

A builder's absence, administration or failure to meet the programme may amount to breach, but the contract commonly prescribes notices, cure periods and termination procedures. Insolvency clauses and legal restrictions can also affect what may be done after an external administrator is appointed.

The owner should obtain specific legal advice on the actual contract and status. Generic termination letters found online can omit a mandatory step or rely on a right that does not exist.

Why the replacement appointment should wait

Giving another builder possession and authority to alter the works can be inconsistent with the first contractor's continuing rights. It can also make it harder to prove the condition at cessation and to allocate later damage.

Urgent safety and protection work may still be necessary. Define it narrowly, notify relevant parties where appropriate and document why delay would cause further loss.

Assemble the termination record

Keep the executed contract, all amendments, notices, builder responses, extension-of-time claims, payment disputes, site diaries, evidence of cessation and legal advice. Record the effective termination date and the basis relied on.

The HBCF completion claim may require evidence that the insured contract was validly terminated. The date may also interact with the 12-month incomplete-work period and the replacement builder's commencement.

Deal with possession and property

The termination process should address keys, site access, plans, certificates, materials, temporary works, hired equipment and documents held by the builder. Not every item on site belongs to the homeowner merely because it is located on the land.

Coordinate with the administrator or liquidator where company property or supplier retention-of-title claims may exist. A written handover reduces later allegations that items disappeared after the owner's takeover.

Practical takeaway: Treat termination as a legal project milestone. A properly documented end to the first contract gives the replacement builder and HBCF claim a cleaner starting point.
